such determinations were aided by the engine control unit – ECU [or black box] found in most cars. 

NHTS has mandated black boxes to be fitted in all new cars as of sept 2014.

many manufacturers have included this capability for a number of years because they wanted reliable records of what happened in a crash.

so you are being monitored whether you know it, or not.
