Colin,

Whether or not there is separation of church and state depends on what church and what state. I'm writing a church history at the moment, and 99% of the battles fought in the UK by churches were over direct state interference.  The interference you refer to is less direct, and it looks as if it is going to get lost in a cloud of semi-denials and obfuscations.  If the chap really wants to take communion, all he has to do is attend another church at the appropriate time.
