yes, ain't it lovely, hugh...................................................!

lawyers take such cases (and thousands of others) at no cost to the (improbably) injured party.

if the case succeeds that lawyer takes 30% plus = win-win. (and how we love win-wins)

if it is a loss - tough for the lawyer.

there are tens of thousands of frivolous cases - and many succeed.

nothing ventured, nothing gained.

the complaint here will be that there should not have been a large hole in the first instance. 

and my client should not need to look where she was going (too much personal responsibility required)

the implication being that the public streets are required to be inherently safe!

however, all is not plain sailing.... trying to get the city/town to pay up is almost impossible. there are probably hundreds of court orders for the city/town to pay up, but there is a system of priority and an individual will be way, way down the list.

large awards for successful suits against companies are frequently overturned later - this after years of appeals.

charles dickens would still recognise the lethargy of the legal system.

Colin,

Like the idiot she is, she wasn't looking where she was going.  She has no defence - it is reasonable to assume anyone capable of walking alone along a pavement is capable of seeing a large hole in front of them.  I assume nobody else fell down it.  Lawsuits must come easy in the US.
